Personal Information Collection Statement
Entry into the ID Land Rosalia – Builder Rebate Promotion (Promotion).
As part of entering into a contract of sale to purchase a lot at the ID Land Rosalia development and entering into the Promotion, you will need to read and agree to this Personal Information Collection Statement.
This Personal Information Collection Statement relates to the collection of personal information in relation to the Promotion.
The Promotion is operated by ID Ross Watt Road Development Pty Ltd ACN 665 677 056 (we, us or our).
We collect and use personal information about you to engage with you in relation to the Promotion. We may also use your personal information for related purposes including to request your feedback on the products and services provided by us.
Wherever possible we will collect personal information directly from you including information that you directly supply when completing the Promotion Form. Such information collected includes your name, phone number, email address, street address and points of identification as evidence of your eligibility to enter into the Promotion. If you do not provide all the personal information we request from you, you will not be able to take part in the Promotion.
We may disclose personal information about you to third party agents and service providers to assist us in conducting, administering and publicising the Promotion , and in the operation of our business to provide the products and services you request. Your personal information will not likely be disclosed to overseas recipients.
Our Privacy Policy contains information about how you may request access to and correction of personal information we hold about you, or to make a complaint about an alleged breach of the Privacy Principles. Our Privacy Policy can be found at rosaliagisborne.com.au.
You agree to us using your personal information in relation to the Promotion and to promote products and services to you. If you no longer wish to receive promotional information from us, you may advise us of your wish. Our Privacy Policy contains information about how you may send your request to us.

These terms and conditions apply to the $20,000 (inclusive of GST) provided by the Promoter and to no other rebate or offer.

ID Land Rosalia – Builder Rebate Promotion (Promotion) is subject to the following terms and conditions: 

Promoter
The Promoter is ID Ross Watt Road Development Pty Ltd ACN 665 677 056 of Level 11, 484 St Kilda Road, Melbourne VIC 3004.

Development
The Development is the development known as “Rosalia” situated at 89 Ross Watt Road, Gisborne Victoria.

Terms and Conditions of Promotion
By entering into a Contract of Sale (defined below), the Purchaser acknowledges their consent to providing their personal information to the Promoter and agrees to and accepts these Promotion terms and conditions.

Please also refer to the Rosalia – Builder Rebate Promotion Special Condition in the Contract of Sale.

Promotion Lots
The lots of land subject to the Promotion are lots 208, 209 and 221 for sale at the Development during the Promotion Period (Promotion Lot).

The Promoter may change the Promotion Lots during the Promotion Period by publishing a notice on the Promoter’s website (www.rosaliagisborne.com.au) (Website) with the updated promotion lots.

Who is eligible for the Promotion?
The Promotion applies to all natural persons, who:
(a) is a resident of Australia;
(b) is 18 years of age and over;
(c) before the close of the Promotion Period, has entered into an unconditional, binding contract of sale between the Applicant as the purchaser and the Promoter as the vendor, for the purchase of a Promotion Lot (Contract of Sale), including payment of the full deposit required under the Contract; and
(d) has complied with the Offer Process (described below).

Employees of the Promoter, as well as the employees of the Promoter’s related entities or associated businesses, contractors and any person working onsite at the Development (including builders), are ineligible to participate in Promotion.

Any eligible Purchaser who, in the opinion of the Promoter, tampers or interferes with the entry mechanism in any way, or who does not properly comply with the Offer Process will be ineligible to be considered for the Promotion.

How to apply?
A separate application is not required. A purchaser who meets the eligibility criteria above is automatically applicable for the Promotion.

Dates of Promotion
The Promotion commences at 9.00am AEST on 25 September 2025 and closes at 6.00pm AEST on 17 October 2025 or until Contracts of Sale have been entered into for 6 Promotion Lots (Promotion Period). Any Contracts of Sale entered into after the closing time will not be considered. The Promoter may end or extend the Promotion Period by publishing a notice on the Promoter’s Website with the dates of the extended promotion period. These terms and conditions apply to any extended promotion period.

Promotion Offer and Offer Process
Subject to these terms and conditions, the eligible Purchaser is offered that the Promoter will pay the Builder AUD $20,000 (Construction Rebate) to be applied against the Building Contract (as defined below) price where the eligible Purchaser, during the Promotion Period has complied with the following Offer Process:
(a) has entered into an unconditional Contract of Sale with the Promoter within the Promotion Period, including paying the full deposit in accordance with the terms of the Contract of Sale;
(b) successfully settles the Contract of Sale on or before the due date;
(c) has complied with all other terms of the Contract of Sale;
(d) within 90 days from the settlement date of the Contract of Sale, enters into a separate domestic building contract with Simonds Homes Victoria Pty Ltd ACN 050 197 610 (Builder) for the construction of a dwelling on a Promotion Lot in accordance with an Approved Design (Building Contract);
(e) provides the Promoter with a copy of the Building Contract within 5 days of satisfying paragraph (d);
(f) submits plans for the dwelling to the design review panel in accordance with the Contract of Sale and obtaining all necessary approvals on those plans prior to commencing construction; and
(g) obtains all necessary permits and consents for construction of the dwelling.

Approved Designs
The Purchaser must enter into a Building Contract with a Builder for one of the approved designs annexed to these terms and conditions, as amended and agreed between the Purchaser and the Builder (Approved Designs).

Construction Rebate
The Construction Rebate will be paid to the Builder within 30 business days of from the Purchaser providing to the Promoter:
(a) evidence in writing (satisfactory to the Promoter) that it has satisfied all requirements in the Offer Process within the relevant timeframes (where applicable);
(b) within 5 business days of the Purchaser receiving notice from the Builder that the dwelling has reached ‘Lock Up Stage’ (as defined in the Building Contract and must at a minimum ensure external wall cladding and roof covering is fixed, the flooring is set and the external doors and windows are fixed) (Lock Up Stage), providing:
(i) evidence in writing (satisfactory to the Promoter acting reasonably) from the Builder that the dwelling on the Promotion Lot has reached Lock Up Stage; and
(ii) a valid tax invoice from the Builder for an amount equivalent to the Construction Rebate; and
(c) an employee, representative or consultant of the Promoter inspecting the dwelling on the Promotion Lot and confirmed by notice in writing to the Builder that it agrees the Lock Up Stage is complete.
The Purchaser acknowledges that the Construction Rebate will not be payable to the Purchaser and will be paid directly to the Builder on behalf of the Purchaser.
The Promoter will not be obliged to confirm that the Builder has applied the Construction Rebate to any outstanding monies payable by the Purchaser under the Building Contract and the Purchaser must liaise with the Builder regarding the application of any Construction Rebate
The Construction Rebate is not transferable or exchangeable and cannot be taken as cash. Offers are limited to one per Contract of Sale.
The Purchaser may forfeit their entitlement to receive the Construction Rebate if:
(a) they fail to settle by the settlement date specified in their Contract of Sale, unless otherwise agreed in writing;
(b) the Purchaser does not comply with the Contract of Sale;
(c) the Building Contract is cancelled or terminated prior to reaching Lock Up Stage; or
(d) they fail to meet the Offer Process requirements despite reasonable opportunity to rectify.

Personal Information
Personal information will be handled in accordance with the Contract of Sale and the Promoter’s Privacy Policy which can be viewed online at rosaliagisborne.com.au.

Promoter’s rights reserved
The Promoter may exclude applications from the Promotion if it reasonably believes the applicant has breached these terms and conditions or applicable laws. Any exclusion will be based on objective criteria and communicated to the Purchaser in writing.

Other Terms and Conditions
(a) The Promotion is governed by the laws of the state of Victoria, Australia. All other terms and conditions in the Contract of Sale apply.
(b) To the extent of any inconsistency between these terms and conditions and the Contract of Sale, the Contract of Sale will prevail.
(c) Terms used but not defined have the meaning given to them in the Contract of Sale.
(d) The Promotion is personal to the Purchaser named in the Contract of Sale and the benefit of this Promotion cannot be transferred to any other party (including any nominee, or subsequent purchaser of the Promotion Lot if the Purchaser on-sells the Promotion Lot) without the express written consent of the Promoter (which may be provided or withheld at its absolute discretion).
(e) The Promotion cannot be taken in conjunction with any other offer, campaign or promotion promoted by the Promoter or any other person (including any rebates offered by the Builder) from time to time without the Promoter’s prior written approval.
(f) The Purchaser acknowledges and agrees that the Promoter makes no representation or warranty as to the Purchaser’s eligibility for any incentive, offer or rebate being offered by the Builder in connection with the Construction Rebate (if any) and any such arrangement or offer is entirely independent to the Promoter.
(g) The Promotion is not an offer of finance. The Promoter or the Vendor takes no responsibility and is not liable for the Purchaser’s stamp duty, strata levies or other tax liabilities or government charges.
(h) To the extent permitted by law, the Promoter and Builder:
i. accept no responsibility for any damage, loss or liabilities that may arise from an eligible Purchaser receiving the Construction Rebate;
ii. shall not be liable for any loss or damage whatsoever (including but not limited to direct, indirect, special or consequential loss or damage, loss revenue or profit) suffered or sustained by the Purchaser arising from participation in the Promotion, receiving the Construction Rebate or the Purchaser’s participation in this Promotion, even if the Promoter has been advised of the possibility of such damages; and
iii. accepts no responsibility for any variation in the value of the Construction Rebate in the Promotion.
This clause does not limit liability for personal injury, fraud, or any other liability that cannot be excluded under the Australian Consumer Law.
(i) If, for any reason whatsoever, the Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failure or any other cause beyond the control of the Promoter which corrupt or affect the administration, security, fairness or integrity or proper conduct of the Promotion, the Promoter reserves its right in its sole discretion to take any action that may be available, subject to State and Territory regulations.
(j) The Promoter reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Promotion for any reason if the Promoter’s circumstances change.
(k) Independent financial, legal or other professional advice should be sought by the Purchaser.
